By entering into a contract for supply with Don Morton Marine Pty Ltd, from this point forward referred to as DMMPL, you, the Consumer, confirm your mutual consent and understanding of these Terms and subsequently also your agreement to be bound by these Conditions subject to the jurisdiction and laws of the relevant state and federal statutory bodies. To ensure that the interests and rights of both you, the Consumer, and DMMPL are protected in accordance with the laws enforceable in the State of South Australia please familiarise yourself with these Terms when placing a request for the supply of spare parts, engines, boats, trailers, products generically termed major units or other such similar products or associated labour and components.
DMMPL is committed to respecting your privacy and takes all practical and reasonable steps to protect any personal information we may hold against loss, unauthorised access, use, modification or disclosure without prior consent. These steps include the secure storage of electronic files, SSL payment gateway encryption and restricted access to the retrieval of identifying and confidential information. DMMPL may however disclose such information to regulatory bodies, government and law enforcement agencies, when or as required, authorised and permitted by law.
DMMPL only collects information that you personally provide to us. This includes information you provide when making an enquiry, a service booking or during your engagement with social media. If a product fails to meet a level of reasonably expected quality, fails to perform in a fit for purpose manner or is significantly different from the product promoted or displayed the Consumer has the right to ask for a replacement or refund. Consumer right of return guarantee does not apply if you receive goods as requested and subsequently change your mind, no longer require the goods, realise that you ordered the supplied goods in error, have found a cheaper item elsewhere or have simply decided you no longer have a use for it.
Unless otherwise stated by Law, acceptance of returned goods and or acknowledgment of product shortages is solely at the discretion of DMMPL. DMMPL will not recognise such instances unless advised by the Consumer, in writing, in either printed or digital format, within seven (7) days of taking delivery. Unless otherwise advised by DMMPL, the Consumer is solely responsible for any postage, freight, restocking and financial institution re-charges incurred when retuning goods for refund or making a request for credit.In order to accept a return or exchange, goods must be in their original unused condition.
When making a claim for credit, a successful claim is not automatic for hazardous materials that include paint, aerosols, lubricants or shelf life products such as rubber goods, belts, hoses, seals, gaskets or special tools or superseded, discontinued or obsolete parts or goods clearly identified prior to purchase as non returnable, non refundable or as being part of a special or customised request order. General:
Don Morton Marine Pty Ltd, from this point forward referred to as DMMPL, will only ship within Australia. Our default shipping provider is FedEx TNT. Items classed as hazardous materials such as paint, aerosols, oils and lubricant will not be shipped to a Post Office Box and will only be shipped by road freight with FedEx TNT. Full risk of loss, including transportation delays, losses and breakages, passes to the Consumer at point of dispatch from the premises of DMMPL. It is recommended that should the Consumer require shipping insurance that they contact DMMPL prior to entering into a purchasing agreement.
DMMPL will endeavour to dispatch all orders within 36 standard business hours upon receiving a shipping request. Please allow an additional 7 days for shipment of Vetus Maxwell & Hydrive Steering products. It is advisable to allow an additional 3-5 days for delivery to a regional area. Where delivery to a Post Office Box is requested, delivery is limited to consolidated items not exceeding either 3kg of weight or dimensions 200mm x 150mm x 100mm. It is recommended that should you be unclear of these terms or should expedited shipping be required that you contact DMMPL prior to entering into a purchasing agreement. Any additional Expedited Freight costs including Express Post or Air Freight requests will be fully payable by the Customer. Where Click N Collect in store pickup has been requested please allow 24 - 48 standard business hours for processing or alternatively contact DMMPL prior to pickup to confirm availability. Where in store pick up is requested, supporting personal identification and presentation of your payment receipt is required.
Shipping Rates:
DMMPL online store Shipping Rates are charged at a flat rate of $17 inclusive of GST per package. Single orders of value greater than $75 inclusive of GST are generally free of additional Shipping and Handling charges. Unless otherwise stated all shipments are ex-warehouse and subject to an additional freight forwarding charge. All charges are displayed during the checkout process prior to payment whereby you will be given the option to proceed with the order or to cancel it.
Back Orders:
DMMPL maintains a comprehensive warehouse of stocked items. On occasion listed items may be placed on back order with our suppliers. If an order for supply contains both stocked and non stocked items, DMMPL may delay shipping to minimise any charges incurred by the Consumer. If an order is urgent please advise when placing the order. If DMMPL are experiencing delays in supply or stock is obsolete, discontinued or no longer available an authorised representative of DMMPL will seek to contact the Consumer to advise. For in-store pickup please contact DMMPL prior to confirm availability.
Payment:
Don Morton Marine Pty Ltd offers a PayPal payment facility as an e-commerce payment option. PayPal is a fast, safe way to make payments without disclosing financial details to the seller. Where in store pick up is requested, supporting personal identification and presentation of your payment card and payment receipt is required. You do not need to have a PayPal account. Australian Consumer Law creates guarantees which automatically protect Australian Consumers. In accordance with this law, Don Morton Marine Pty Ltd ascertains to the best of its knowledge and ability that consumer goods provided are of acceptable quality without defects and match the descriptions made on the packaging and labels and in promotions or advertising. Use of parts, kits and accessories for commercial or competitive activity or in a manner not intended by the manufacturer may render the existence of any warranty null and void. Parts, kits and accessories generically termed as sacrificial are supplied void of usage warranty.
The manufacturer BRP makes no express warranties beyond that as required by law with the exception that for a period of twelve (12) months starting from the date of the initial retail sale, BRP will repair or replace BRP genuine Parts and Accessories if found defective in material and or workmanship further to normal use and service. Labour and collateral damages to the vehicle are not covered if the failed part or accessory was not installed by a BRP authorised dealer or BRP authorised distributor. The manufacturer may from time to time review and revise any express warranties beyond that as required by law.
